Innovative Healthcare
Terms of Service
Effective Date: October 8, 2026

These Terms of Service (“Terms”) govern your use of Innovative Healthcare’s website, online forms, patient-facing digital services, electronic communications, and text messaging program (collectively, the “Services”). By accessing or using a Service, you agree to the provisions of these Terms that apply to that Service. Participation in text messaging remains subject to any consent or authorization required by applicable law and to the opt-out rights described below. If you do not agree to these Terms, do not use the applicable Service. These Terms supplement our Notice of Privacy Practices and do not replace your rights under applicable privacy law.

1. Use of the Services

You may use the Services only for lawful, personal purposes and in accordance with these Terms. You may not interfere with their operation or security; attempt unauthorized access; submit false, harmful, or unlawful content; impersonate another person; or violate another person’s rights. We may suspend or restrict access when reasonably necessary to protect patients, our workforce, or the Services.

2. Health Information and Medical Disclaimer

General information made available through the Services is for educational and administrative purposes and is not a substitute for individualized medical advice, diagnosis, or treatment. Use of the website or electronic communications does not by itself establish a clinician-patient relationship. Clinical care is governed by the applicable patient relationship, consent documents, and professional standards. Always contact a qualified health care professional with questions about a medical condition or treatment.

3. Emergencies

Do not use the Services, email, online forms, portal messages, or text messaging for emergencies, urgent medical needs, or time-sensitive clinical concerns. Call 911 or seek immediate medical assistance.

4. Privacy and Security

Our use and disclosure of protected health information is described in our Notice of Privacy Practices. Information collected through the website or other Services that is not protected health information is handled as described in the Website Privacy section of that Notice and any other applicable privacy notice. Although we use reasonable safeguards, no website, network, email, or portal system can be guaranteed to be completely secure or continuously available. The Text Messaging section below explains the additional privacy and delivery limitations of SMS. You are responsible for safeguarding your devices, passwords, and account access.

5. Accounts, Information, and Patient Responsibilities

You agree to provide accurate and current information, keep your contact information updated, protect login credentials, and notify us promptly of suspected unauthorized access or a reassigned telephone number. You are responsible for reviewing communications and following up directly when a response is needed. Do not share another person’s information unless you are authorized to do so.

6. Appointments, Payments, and Availability

Appointment requests are not confirmed until accepted by Innovative Healthcare. Fees, payment obligations, cancellation requirements, refunds, and other practice policies are governed by the documents or notices provided for the applicable service. We may modify, interrupt, or discontinue any digital feature when reasonably necessary. Electronic delivery failures do not excuse payment obligations.

7. Text Messaging

If you provide a mobile telephone number, we may send texts for treatment, payment, and health care operations, including appointment reminders, scheduling, care coordination, billing or payment questions, patient-service messages, and responses to your requests, as permitted by law. We will obtain any consent or authorization required by applicable law before sending automated, promotional, or marketing texts. Consent to marketing or promotional texts is not a condition of receiving care. Message frequency varies, and message and data rates may apply.

Standard SMS may not be encrypted and may be accessed by anyone with access to your phone, shared device, cellular account, or notifications. Messages may be delayed, misdirected, intercepted, filtered, or retained by your carrier or device, and carriers are not liable for delayed or undelivered messages. You represent that you are the subscriber or customary user of the number provided and will notify us if it changes or is reassigned.

You may ask us to stop text messages that require your consent by replying STOP, using another reasonable opt-out method, telling a member of our workforce, or calling (903) 357-5430. We will honor applicable revocation requests within the period required by law. We may send one final message confirming your request and may contact you by another permitted method. For assistance, reply HELP or call (903) 357-5430. Opting out of text messages will not affect your right to receive care, although it may require us to communicate with you through another channel.

8. Third-Party Services and Links

The Services may link to or depend on third-party websites, carriers, payment processors, portals, or technology providers. Their availability, content, security, and privacy practices are governed by their own terms and notices. A link or integration does not imply endorsement, and Innovative Healthcare is not responsible for third-party services to the extent permitted by law.

9. Intellectual Property

Unless otherwise stated, the Services and their text, graphics, logos, and other content are owned by or licensed to Innovative Healthcare and are protected by applicable intellectual-property laws. You may view or print content for personal, noncommercial use. You may not copy, modify, distribute, sell, or create derivative works without prior written permission, except as permitted by law.

10. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, the digital and informational features of the Services are provided on an “as is” and “as available” basis without warranties of uninterrupted operation, error-free content, or fitness for a particular purpose. Innovative Healthcare is not responsible for losses caused solely by third-party systems, network failures, unauthorized device access, delayed electronic communications, or reliance on general informational content, except where liability cannot lawfully be excluded or limited. This section does not limit liability arising from professional health care services, breach of duties imposed by applicable privacy or consumer- protection law, or any other rights or remedies that cannot be waived.

11. Changes, Termination, and Governing Law

We may revise these Terms and will make material changes available through our website, patient materials, or another appropriate notice. Continued use after revised Terms take effect constitutes acceptance, except where additional consent is required by law. We may restrict or terminate access for misuse or security reasons. These Terms are governed by applicable federal law and Texas law, without limiting rights that cannot be waived.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. A failure by Innovative Healthcare to enforce a provision on one occasion does not waive the right to enforce that provision or another provision later.

12. Contact Information

For questions about these Terms, the Services, or text-message preferences, contact Innovative Healthcare at (903) 357-5430.
